Terms of Service

1. About these terms

These Terms of Service ("terms") are an agreement between you and ICT-Hoogeveen ("Recaris", "we", "us"), established in the Netherlands. Our full company details are in the Legal notice.

They apply to recaris.eu (including your account and store), all game servers operated by Recaris, and our Discord server (together: "the service"). By creating an account, joining our servers or buying something, you agree to these terms. Our Privacy Policy explains how we handle personal data.

If you are a consumer, nothing in these terms limits the rights you have under the mandatory consumer law of the country where you live.

2. Not an official Minecraft service

To play you need a legitimate Minecraft account. Your use of Minecraft itself is governed by the Minecraft End User License Agreement and the Microsoft Services Agreement; we do not change those. "Minecraft" is a trademark of Mojang AB / Microsoft. Payments to Recaris go to us, not to Mojang or Microsoft, and Mojang and Microsoft are not responsible for our service.

3. Age and parental consent

• Under 13: you may not create a Recaris website account or buy anything from the store.
• 13 to 15: you may create an account only if your parent or legal guardian agrees.
• Under 18: you may only buy something with permission from your parent or legal guardian, and with a payment method you are allowed to use.

Parents and guardians are responsible for the use of the service by their children. If you are a parent and believe your child made a purchase or created an account without your permission, contact us at support@recaris.eu - we will help, and we will delete a child's account on request.

4. Your account

• Give a valid email address and keep your password secret. You are responsible for what happens on your account.
• One website account per person. Accounts, ranks and linked profiles may not be sold, traded or shared.
• A Minecraft profile and a Discord account can each be linked to only one Recaris account. Only link accounts that are yours.
• You can stop using the service at any time and ask us to delete your account (see the Privacy Policy). Deleting your account ends your access to ranks and items linked to it; we keep order records for as long as tax law requires.

5. Rules and conduct

The server and Discord rules are part of these terms. In addition you may not:

• break the law, or post anything illegal, hateful, sexual, threatening or that infringes someone else's rights;
• cheat, exploit bugs, use unfair modifications or attack, overload or reverse-engineer our servers or website;
• evade a punishment with another account, or impersonate staff or other players;
• sell or trade in-game items, ranks or accounts for real money outside our store;
• use automated tools to scrape the website or create accounts.

Using Discord (including linking it to Recaris) also means accepting Discord's own Terms of Service and Community Guidelines.

6. Content you create

You keep the rights to what you create: chat messages, builds, names, banners, ticket messages and screenshots ("your content"). To run the service you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, show and moderate your content on the service, and to show builds in screenshots and videos about Recaris. Builds in shared worlds stay part of that world, so this licence lasts as long as the world exists. You confirm you have the right to share what you upload.

7. Moderation, reports and appeals

We moderate the service to keep it safe and within the law and the rules. Moderation is done by our staff, supported by automated tools such as chat filters, anti-cheat and alt-account detection (see the Privacy Policy). Possible measures are a warning, removing content, a mute, a kick, a temporary or permanent ban, or restricting your account or store items.

• Reasons: when we restrict you, we tell you the reason in game and on My account (type, reason, date and end date), unless that would be unlawful.
• Appeals: you can contest any decision for free through Appeal a punishment. A staff member who did not take the original decision where possible reviews it, and we tell you the outcome.
• Reporting illegal content: anyone can report content on our service they believe is illegal by emailing support@recaris.eu. Please include where the content is (server, place, player name or link), why it is illegal, your name and email, and a statement that your report is accurate and made in good faith. We confirm receipt, decide carefully and without undue delay, and tell you what we did.
• Contact point for authorities and users (EU Digital Services Act): support@recaris.eu, in English or Dutch.

8. Store: ranks and virtual items

What you buy

The store sells ranks as monthly memberships. A rank is a virtual entitlement: you get a personal, non-transferable, revocable licence to use its prefix and listed benefits while the membership is active. It has no monetary value, cannot be exchanged for money or transferred to another player, and is not your property.

Rank benefits are a styled prefix, a Discord role (with a linked Discord account), cosmetic chat extras such as a nickname or join message, and extra homes on Legacies (the modpack servers have their own home limits per rank). The exact benefits are listed with each rank. We do not sell gear, kits, land claims, chunk loading or progression shortcuts; extra claimed and force-loaded chunks on the modpack servers are free for players who link their Discord account and are not part of any rank you buy.

Nicknames and join messages must follow the rules. Your real Minecraft name always stays visible (on hover and with /realname), and staff can reset a nickname or join message that breaks the rules.

Price, payment and delivery

• Prices are shown in euro (EUR) and include VAT. The price shown at checkout is the total you pay; there are no extra fees. You always pay in euro. The store can also show an approximate price in another currency for your convenience (based on the European Central Bank reference rate); that amount is only an indication - your bank or card provider sets the final exchange rate and any conversion costs.
• Payments are handled by our payment provider Mollie. We never see your full card or bank details.
• The contract is made when your payment is confirmed. We then deliver the item automatically to your linked Minecraft profile, normally within minutes, and send an order confirmation by email.
• Each rank membership renews monthly until cancelled. The rank remains active through the paid period.
• If an item is not delivered or does not work as described, contact us: we will fix it, or refund you if we cannot.

Changes to items

We may adjust ranks and items for game balance, technical, legal or platform reasons (for example to follow Mojang's usage guidelines). If a change to something you paid for negatively affects you more than in a minor way, we tell you in advance and you may end the contract free of charge within 30 days of the change; we then refund the part you have not been able to use, as the law requires.

9. Monthly memberships

• A membership is a subscription: you pay the monthly price shown at checkout, and it renews automatically every month until you cancel. Mollie charges the payment method you used for the first payment.
• You can cancel at any time on My account (or by emailing us). No further payments are taken; you keep the rank until the end of the month you already paid for.
• If a renewal payment fails, the rank stays active for 5 days after the paid period and then ends until a payment succeeds.
• We may change the monthly price for the future. We tell you at least 30 days before it applies to you, and you can cancel before then.

10. Right of withdrawal

As a consumer in the EU/EEA or the UK you normally have 14 days to withdraw from an online purchase. For digital content that we deliver immediately, this right ends once delivery has started, but only if you expressly asked us to deliver immediately, acknowledged that you lose your right of withdrawal, and we confirmed this to you by email. 11. Bans, chargebacks and closure

• If we ban or restrict you because you broke these terms or the rules, you lose access to your ranks and items for as long as the measure lasts, and you are not entitled to a refund for them, to the extent the law allows. If an appeal shows a punishment was wrong, we restore your items.
• Please contact us before starting a chargeback or payment dispute. While a chargeback is open, the related items may be paused; after a chargeback we may remove them.
• If we permanently close Recaris, we announce this at least 30 days in advance, stop all membership payments and refund any prepaid membership period you could not use. Your statutory rights remain unaffected.

12. Availability and changes

We work hard to keep the servers online, but we cannot promise uninterrupted availability: maintenance, updates, outages at our host or at Mojang/Microsoft, and attacks can cause downtime. The Legacies world is designed to be permanent and never reset; we make regular backups but cannot guarantee against data loss. We may change, add or remove features, servers and game modes over time.

13. Liability

The service is provided free of charge, apart from the optional items you buy. To the extent the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the event that caused the damage, and we are not liable for indirect or consequential damage, loss of virtual items caused by your own breach of these terms, or damage caused by services of third parties (such as Mojang, Microsoft, Discord or Mollie).

These limits do not apply to damage caused by our intent or gross negligence, to death or personal injury, or to any liability that cannot be limited under mandatory law, including your rights as a consumer when digital content does not conform to the contract.

14. Intellectual property

The Recaris name, logo, website, plugins and texts belong to us or our licensors. You may share screenshots and videos of your gameplay. Minecraft and related names and assets belong to Mojang AB / Microsoft.

15. Changes to these terms

We may update these terms, for example when the law or our service changes. Material changes that affect paid items or memberships are announced at least 30 days in advance on the website and, where possible, by email. If you do not agree, you may cancel your membership and stop using the service before the change takes effect.

16. Governing law and complaints

• These terms are governed by Dutch law. If you are a consumer living in another country, you also keep the protection of the mandatory rules of the law of your country.
• Disputes go to the competent court in the Netherlands. As a consumer you may also go to the courts where you live.
• Complaints: email support@recaris.eu. We reply within 14 days. We would much rather solve a problem with you directly.
• If a clause of these terms is invalid, the rest remains in force.
